The Ministry of Labor of Costa Rica found 2664 businesses or commercial establishments that do not insure their workers or the Costa Rican Social Security Fund (CCSS) or the National Insurance Institute (INS).

Companies are legally required to enroll employees in the CCSS to have access to disability, old age and 'Insurance and the INS in order to be covered in case any accident or risk should occur.

The lack of registration of workers in the CCSS and INS were detected during the first months of the year during raids carried out by Labor Ministry inspectors to verify compliance with these requirements as well as paying premiums.

In total, 3600 inspectors visited the business premises throughout the country. The data were supplied by the head of the National Inspection of the Ministry of Labor in Costa Rica, Rodrigo Acuña. He said the establishments were chosen as indicators to show the vulnerability of workers.

The main factor was the size of the company. According to Acuna, the lack of compliance was more common in firms with fewer staff.

Of the 3,600 establishments, 1,440 uninsured workers to the INS, while 1224 did not report their payroll to the CCSS. In some cases, Acuna said that some companies not meet both requirements.

Manuel Rodriguez, president of the Union of Chambers and Private Enterprise (UCCAEP) in Costa Rica, said that the obligation to pay the bonuses to all employees by December 20, and the obligation to ensure that the worker has been promoted among all members.

"UCCAEP has contributed to strengthening the inspection work and this is the only institution responsible for ensuring compliance with existing labor legislation, "said Rodriguez.

Inspectors also found 720 companies that do not pay a Christmas bonus to its workers, so there was a complaint lodged against them in Courts of Justice in Costa Rica. Rodrigo Acuña said that in the face of the complaint, most workers received their bonus.

The penalty for those who can not pay the premium can be anywhere from 11 to 13 base wages or ¢ 2.5 million, approximately. Minister of Labor, Alvaro Gonzalez, said the lack of compliance with the call number monthly wage of 13 is common in companies with few employees in 13 companies staff number.

Gonzalez gave the example of domestic workers in Costa Rica. "The problem is that sometimes the employer lacks the resources to meet that payment, but that's no excuse, of course."

The bond must be paid before December 20. The Ministry of Labor plans to inspect more than 4,000 companies this year.

These inspections and sanctions should be implemented on a more regular basis. However, large companies should also be inspected, because sometimes do not comply with labor laws as well.
