meaning of the safe release clause?
reached agreement on a settlement with the insurance company accident car damage (another individual, who pay me). Relase sent a form that includes this paragraph: It is understood and agreed that a party is free not admit any liability to the undersigned or any other, -> will not stop or otherwise prohibited from asserting, and expressly reserves the right to assert any claim or cause of they may take action against the undersigned or otherwise. <- What is the best here ?!?!? Believe they want to preserve the right to sue me. Do not understand why this would be part of a release form. There is no doubt who is to blame. There is no reason why they sued me. Why what is here. (and not say it's just a clause in values – which is a non-response) Pls feedback from the people who really know what they are talking.
Though asked not to listen, I must say it is an "action clause" found in all the versions used in settling claims insurance. The wording might be slightly different in some versions, but it all means the same thing. Frankly, you have nothing to worry about. I have seen reported with the language used, probably 1000 times on both sides of a complaint. I've never seen anyone being sued over it. If it really concerns then you have two options 1) ask the insurance company to remove it (which they will not) or 2) consult an attorney to review for you. The first sentence that includes is very basic. ANY insurance settlement is a compromise and never states that the guilty party is admitting fault. If the roles were reversed his company uses the same language on their behalf. This is nothing to worry about once you get your check. The second phrase is included for two reasons. 1) In some cases, an accident could be considered 50% because of the two drivers in many states means that each driver can make a claim for 50% of the damages against the other driver. The insurance company solution can not do anything that would remove its policyholders the right to a solution if 50/50%. This language maintains the insurance company to make their claims by right away. And 2) in the U.S. anybody can sue anybody at any time. We all have that right, even if they have a legitimate case. The release includes this language, because the insurance company can not take away their right to sue the insured with this release. You may want to call your insurance company and try to talk to one of the adjusters of the release. Really care about anything. Millions of people sign these every year with no adverse effects.
