How to report an ethical lawyer?

My friends an I were in a car accident about 4 years. We received a settlement (3 years) insurance company to my friends (PIP). But we are still waiting in the settlement of the guy who was at fault. Every time I call the attorney, he doesn't answer any of my calls and his voicemail is always full. I think the lawyer has received the agreement and has kept the money. Do I have any rights? Should I report it? If so, how and why?

Ummm … Have you ever tried to see him in person? Suffice to say I can not reach him by phone is reason enough to jump to such conclusion, and I guarantee that if you tell the bar that is all they have done to try to communicate with him will dismiss his complaint. Try to write the emails, and going to his office and ask to see it. If you can prove that they have repeatedly tried various means of communication with his lawyer and it is unfair to ignore that then there would be a legitimate reason to file a complaint with the Bar Association in your state. He was also quick to jump a bit judge the situation … a lot of guesswork and speculation. You can call the insurance company and ask about the second settlement. If you can prove that have been sent and your attorney is unduly support payment from you, then certainly a violation of ethics. However, if no agreement has been sent (as is entirely possible), then the only problem here is jumping to conclusions. It is easy to formulate a hypothesis, but if you really want to resolve this situation that needs testing.
