Car Accident not my fault. Subrogation or small claims court?
Four weeks ago, an idiot took an illegal right turn left before me. I could not avoid hitting him. The police gave him a citation. Police Report clearly states that he was to blame, not me. I would have gone through the company other driver's insurance, Ameriprise, but no one could tell me how do to it. After two weeks, I went through my insurance company, progressive, becuz i needed my car. I paid my deductible, plus the cost of renting a car in front. I was given verbal assurances by Progressive that once the Ameriprise is agree that the other driver is responsible for going to recover the money. Ameriprise is not returning calls from anyone. Now I just received a letter from the unit States surrogacy NOT GET Ameriprise full or partial refund if you cooperate or to incur expenses or legal fees Progressive! WTF! Should I take Ameriprise to the small claims court instead of letting me handle Progress? What are my options to get fully reimbursed?
OK. Relax and breathe deeply. This situation is not as bad as it looks like you. I have a subrogation recovery company working for various insurance companies and tell you what is happening. First, the letter from Progressive is only a form letter, that's all. Probably not worded correctly, but simply progressive is trying to give a worst case scenario. Progressive is not going to incur legal expenses in this file, because both Ameriprise and progressive members of Arbitration Forums (AF). Think of AF as the court of claims to insurance companies. Since both companies are members of the FA can not sue each other, so there will be to incur legal expenses. Any dispute must be made through AF and lawyers are involved. Ask your progressive adjustment of it. You can sue the another driver for your deductible. You can not sue Amerprise, you should sue the other driver and you can only sue for your deductible and any other accident-related expenses not covered by Progress, as your rental car. Frankly, the claim against the other driver is a waste of time and about $ 75 for filing fee judiciary. Through the process of AF, Progressive does all the work for you. FYI, depending on the state it is found to be partly to blame for the accident (that, s called comparative negligence) and whether your expenses are deductible and rental cars could be reduced slightly.
