You should be able to make a claim for medical expenses. However, in California, if you are not covered liability to yourself, you can not sue for pain and suffering losses. Lawyers are more interested in representing people with "pain and suffering" losses, as these are the big dollar settlements. Do not worry about getting a lawyer and sue the insurance company unless they give you a hard time on the payment of medical expenses directly related to their injuries in accidents.
