Insurance eligibility audit group (after injury)?
My husband and I have a small business and have had Blue Cross / Shiels VA since 2003. We are the only employees. I was in a violent accident in 2007. I've had 3 surgeries with more to go. A letter from Blue Cross saying he was being Auditi! To determine my eligibility? I was hurt to the point of needing a wheelchair and want to make sure I'm working 40 hours a week? How I handle this? I am very grateful for any advice.
The IRS requires employers to keep employees only on your health insurance plan group if are working at least 35 hours per week. This was originally approved in the law, because business owners are friends and family to politics, which were not actually employees of the company, it does not really work or earn a paycheck. So now, once your FMLA time is up, if unable to work, your choice is to stay in the use of COBRA plan, or be left out of the plan. No employer shall, not the insurance company said, is the law, passed by their representatives, and the insurance company and your employer would be very heavy fines if they broke the law. Not much you can do. Probably not eligible, unless you're working.
