Assembly Bill 2387 (Vargas, Chapter 590, Statutes of 2006) became law on September 28 2006 to
enter into force on 1 January 2007. This bill amends section 1749 of the California Insurance Code to remove
the word "class" the prelicensing requirement and add Section 1749 (g) to ensure that safeguards
are in place to maintain the integrity of prelicensing education. As a result of this change, prelicensing
education providers approved by the California Department of Insurance (CDI) can now be submitted online
courses prelicensing education to the Commissioner for approval.
Although the regulations required to implement this legislative change, the Commission will review these courses
before The Office of Administrative Law approved the regulations. Courses approved by the CDI
with a "provisional approval", which means that the course can be offered immediately as with the case of any
Commission approved course. However, these courses are subject to review after approving the Regulation
that could potentially result in required changes in the course.
So far as the California Code of Regulations may be amended to reflect the change in the statute, the
comments online prelicensing education courses are able to ensure that they meet the
requirements of Section 1749 of the Code California Insurance. Section 1749, in part,
