Settlement of insurance claims from car accidents?
Hey guys, I was in a car accident Nov. 18 last year. Hired an attorney in January and have a good case. He seems to be taking forever to get the money belongs to me. How long these types of cases, past and when I expect my claim to be settled? I need the money now so I can start my life. Is there any way to speed up the process and could obtain loans from my lawyer if he knows I'm doing a big settlement? He says he only hopes to solve Geico. I'm very impatient and I need money ASAP. Thanks beforehand! Star is being settled out of court. He says the claim is now 30k. Also, my lawyer said he is faxed a letter and is waiting for your response. I think that's about as far as it is now. We are waiting for the insurance company (Geico) to solve … how long these types are taken!?
Every time you hire a lawyer the claim settlement process takes time. Rather than speak directly to the company insurance – the conversations of the insurance company to attny – attny talks to you – again attny insurance company, etc.. A bit like the game children "telephone". Your attny should have explained the process to you – but here goes: Once you are completed with their medical treatment have been released from Dominican Republic – attny the office of his willingness to order copies of your medical bills and records. This can easily take 6 weeks to go I had some dr offices have 6 months to get the records for me, but 6 weeks seems to be a medium in my area. The primary treatment – more providers, more records to gather – the longer it takes. Once the records are in – the office of a package of attny meet demand. This includes photos, police report, medical bills and records and letter attny / demand. How long this takes depends on how busy your attny is. I've called several offices for the package attny tell me they have got the records and are putting the package together and get me in the "near future". 2 months later – still do not. Once the package leaves – is sent to the regulator of review. Again, depending on the size of the package and how busy the controller is – it can easily take 1 month for the adjuster to review the package and Back to attny with an offer. If there is lack of information packet, call the attny adjuster and request the missing information. The process begins again. Once the regulator has considered a complete package and not lack of information – negotiations begin. At some point, the attny get with you about the company's offerings insurance – and then came back with the adjuster. How long this takes depends on you and your attny. Once settlement is reached, the adjuster will send a settlement check and release their attny. The attny usually deposit the check into an escrow account and you sign the statement. He will return to the insurance company release. At this point – the company insurance about your record. Now his attny talk with medical providers and try to reduce their medical charges. The agreement has to check pay for 3 things 1. their medical bills, 2. its attny for his services, 3 Whats left goes to you. So attny must deal first with medical providers. If you can get its reduction of privileges that means more money for you and him. Once again people, health care providers also are busy – your claim Not the only one that is working. I can not say how long this process – but as a good bit of it is in writing – expect it to take weeks / months. Once the health are the subject of mortgages – attny then dispersed the remaining funds that you and him for his services. Some attnys or its clients get the bright idea to bring a claim – Thinking that will make the insurance company out of the pen of magic and things go faster. This is not the case. All a law suit does is bring the above process to a screeching halt. Now, even before reaching the steps above will have to go through discovery. Lawsuits usually take 2-5 years to resolve. Also – insurance companies are not threatened by lawsuits. We take care of them and attnys all the time. Thus a attny sent me a letter threatening to sue me – it's a whole lot of nothing and is abhorrent. So – in short – this is not a statement – a lottery – which is not fast money. If need money to "get on with my life" – get a job.
