Should not the law of liability insurance as part of tort reform?

I've been thinking of allocating liability reform as part of the issue of health care. What bothers me the most important is that there is no penalty for doctors who mess up award or who spoiled big time. not for simple mistakes, but doctors who are really careless. (think medical micheal Jackson) In the case of MJ, if the police not accusing him of killing the man would have only a slap on the wrist … and how likely would have been if MJ was not such a high profile case? As is insurance pays the bill for bad doctors and the rest of the medical community pays the price with high rates. So if what we do is place limits on the amounts people acquired in informal settlements should also set limits on insurance so that doctors themselves may feel when they are to blame?

I agree that doctors need to really be accountable for their actions. I understand that mistakes happen and just because it causes harm, does not mean that there was no malice expected. When doctors make a mistake and hurt someone, it must compensate the injured party. But if there is willful neglect, then the doctor should face sanctions severe that only the payment of fines. I think the whole concept of punitive damages is ridiculous. If someone has done something that should be punished, it is a criminal matter is not an issue civil. Sanctions are also professionals that may be imposed as the medical license revocation. But if there is intent or gross negligence leading to serious injury to another person, put the bastard in jail. In making the punitive damages equation will reduce demand for damages and thus bring malpractice premiums care. And putting criminal penalties for negligence leading to the medical profession wrong. Good doctors can reduce their prices and bad doctors not continue making the same mistakes.
